TERMS AND CONDITIONS OF SALE AND USE – Climéo

Last updated: 25 September 2026

These Terms and Conditions (“Terms”) govern the use of the Climéo online store available at boutique.climeo.eu and the conclusion of sales contracts through it.

The seller is:

FROSTMEISTER PIWOWAR SPÓŁKA KOMANDYTOWA
ul. Duchnicka 3/BUD. 16
01-796 Warsaw, Poland
EU VAT ID: 5253034983
Email: office@climeo.eu
Phone: +48 695 200 950

The store operates under the Climéo brand and uses Shopify’s technological infrastructure.

Using the store and placing an order constitutes acceptance of these Terms to the extent necessary to conclude and perform the contract. Mandatory consumer rights under applicable law remain fully preserved.

1. USE OF THE STORE

The store may be used by persons who have the legal capacity required to enter into the relevant contract.

When placing an order, the customer must provide accurate, current and complete information needed to process it, including contact details, delivery address and required payment information.

The customer is responsible for the accuracy of the information provided. If the customer has an account, access credentials should be appropriately protected.

2. PRODUCTS

We take reasonable care to ensure that product information, descriptions, photographs and characteristics shown in the store are accurate and up to date.

Colours or other visual characteristics may differ slightly from their on-screen appearance because of device settings.

Information on intended use, method of use, compatibility and precautions on the product page, label or instructions forms part of the product information.

Products should be used in accordance with their intended purpose and applicable instructions.

We may modify our offer, product availability or discontinue individual products. This does not affect rights arising from contracts already concluded.

3. ORDERS AND CONCLUSION OF CONTRACT

Products may be ordered through the online store.

Before placing an order, the customer can review selected products, quantities, prices, delivery costs and other material order information.

Placing an order constitutes an offer to purchase the products specified in the order.

After the order is placed, we send a confirmation containing the main purchase information to the email address provided by the customer.

The sales contract is concluded when Climéo accepts the order.

If fulfilment becomes impossible for reasons beyond our control, we will inform the customer and refund any payments received.

We may refuse fulfilment in particular in the event of an obvious pricing or availability error, failed payment authorisation, reasonable suspicion of fraud or where fulfilment would be unlawful.

4. PRICES AND PAYMENT

Prices displayed to consumers in the store are gross prices and include applicable VAT where due.

Before the order is finally placed, the customer is informed of the total price, delivery costs and any other mandatory charges.

The applicable price is the price displayed when the order is placed, subject to obvious pricing errors.

Available payment methods are shown during checkout. Payments may be processed by external payment service providers in accordance with their technical terms.

5. DELIVERY

Available delivery methods, their cost and estimated delivery time are shown to the customer during checkout.

The delivery times shown include the time required to process the order and transport it to the customer.

If a delivery delay occurs, we will inform the customer where possible. Statutory consumer rights in the event of delayed or failed delivery remain unaffected.

In sales to consumers, the risk of accidental loss of or damage to the product passes to the consumer only when the consumer or a third party designated by them, other than the carrier, takes physical possession of the product.

If the consumer independently commissions a carrier whose choice was not offered by Climéo, the applicable statutory rules concerning transfer of risk apply.

6. RIGHT OF WITHDRAWAL AND RETURNS

Consumers have a statutory right to withdraw from distance contracts in accordance with applicable law.

Detailed information about the right of withdrawal, our voluntary 30-day return policy, return costs and the return procedure is available in our Refund Policy.

Our voluntary return policy does not limit statutory consumer rights.

7. DEFECTS, CONFORMITY AND COMPLAINTS

The seller is responsible to consumers for conformity of the product with the contract as required by applicable law.

If a product received is damaged, defective, incorrect or not in conformity with the contract, the customer may contact us at office@climeo.eu.

Please provide information allowing us to identify the order and a description of the problem.

Photographs may facilitate and accelerate the handling of the complaint, but providing them is not a condition for exercising statutory rights.

Nothing in these Terms excludes or limits the seller’s liability where such exclusion or limitation is prohibited by mandatory law.

8. INTELLECTUAL PROPERTY

Store content, including names, logos, photographs, graphics, text, videos, graphic elements and page presentation, may be protected by intellectual property rights belonging to Climéo, affiliated entities, Shopify or other rights holders.

Use of such content beyond use permitted by law or ordinary use of the store requires an appropriate legal basis or the consent of the rights holder.

9. THIRD-PARTY SERVICES AND TOOLS

The store may use external service providers, including payment providers, carriers and providers of technical, analytical or marketing tools.

Some functions may be subject to additional terms of the relevant provider. The customer will be informed where required.

Links to third-party websites are provided to facilitate access to certain information or services. We are responsible for independent external content only to the extent required by law.

10. SHOPIFY

The Climéo store uses Shopify’s technology platform.

Sales contracts are, however, concluded directly between the customer and FROSTMEISTER PIWOWAR SPÓŁKA KOMANDYTOWA, operating under the Climéo brand, and not with Shopify.

11. PERSONAL DATA

Rules governing the processing of personal data are described in our Privacy Policy.

To the extent necessary to provide services, data may also be processed by providers of technical infrastructure, payment services, carriers and other entities identified in the Privacy Policy.

12. REVIEWS AND USER CONTENT

If a customer voluntarily provides a review, rating, photograph or other content, they must have the rights required to share it.

It is prohibited to submit content that is unlawful, misleading, defamatory, offensive, infringes third-party rights or contains malicious software.

We may remove or restrict access to content that violates the law, these Terms or third-party rights.

13. ERRORS AND INACCURACIES

Despite reasonable care, errors or outdated information may appear in the store, including in descriptions, availability, prices or promotions.

We may correct such errors and update information.

If an error concerns an order already placed and affects fulfilment, we will inform the customer and take appropriate action in accordance with applicable law.

14. PROHIBITED USE

The store may not be used unlawfully or in a manner that infringes the rights of others.

In particular, it is prohibited to interfere with store operation, circumvent security measures, gain unauthorised access to data or systems, distribute malicious software, impersonate others or use the store for fraudulent activity.

15. LIABILITY

We are responsible for performing contracts concluded with customers in accordance with applicable law.

We do not exclude or limit liability where such exclusion or limitation is prohibited by mandatory law, in particular consumer-protection rules.

We are not liable for problems resulting exclusively from the customer’s acts or omissions, force majeure or third parties for whom we are not legally responsible.

This section does not limit consumer rights concerning delivery, conformity, withdrawal or any other statutory rights.

16. ENDING USE OF THE STORE

The customer may stop using the store at any time.

We may restrict access to certain functions in the event of a breach of law, store security or these Terms, without affecting rights arising from contracts already concluded.

17. SEVERABILITY

If any provision is invalid, ineffective or unenforceable, this does not affect the validity of the remaining provisions.

The relevant provisions of applicable law apply in place of the invalid provision.

18. GOVERNING LAW

These Terms and contracts concluded through the store are governed by Polish law.

The choice of Polish law does not deprive consumers of the protection afforded by mandatory provisions of the law of their country of habitual residence where those provisions apply under the relevant rules of European Union law.

Jurisdiction is determined in accordance with applicable law.

These Terms do not limit a consumer’s right to bring claims before a court having jurisdiction under consumer-protection rules.

19. CHANGES TO THESE TERMS

The current version of these Terms is available in the store.

We may update the Terms due to changes in law, operation of the store, services offered or for other justified reasons.

Changes do not affect rights acquired under contracts concluded before they take effect.

Where applicable law requires advance notice, it will be provided in the required manner.
